Remember to factor in your estate agency fees

In most sale transactions you will also need to pay your estate agent fees which are usually charged as a percentage of the sale price and is on average between 1%-2%.

Our fees assume:

  • This is a standard transaction and that no unexpected aspects arise such as a defective title needing rectifying before exchange, or other corrective documents needing to be produced.
  • All parties to the transaction are collaborative with no undue slowness from 3rd parties in supplying paperwork.
  • The matter is run in a timely fashion and no other external unexpected items materialise.
  • No specialist insurance (indemnity) policies are needed. Extra fees & 3rd party costs will apply if these are needed.
  • Additional fees will also be payable if the property is New (£950 + vat), purchased using a Help to Buy ISA (extra £150 + vat per person), or Shared Ownership (£950 + vat).
  • If you are receiving a gift or loan from a 3rd party to purchase your Property (eg a gift of some or all of the deposit from a friend/parent) extra fees of £150 + vat per giftor for that gift will be due to cover our time spent with the necessary extra work complying with regulatory requirements, ID checks and dealing with additional documentation. We will also need to deal with your lender’s requirements.
  • Leasehold properties – there are 3rd party costs which may be chargeable under the terms of the Lease, particularly with purchase of a leasehold property. These fees are set by the freeholder or their managing agents, so we will only be able to confirm a figure once we have received the Management Information. The below list sets out typical fees charged in a purchase matter. In the sale of a leasehold property you will not usually need to pay as many third party costs, but you will need to purchase a Management Information pack for your buyer from your Landlord/Management Company or their agent, which usually costs in the region of a few hundred pounds.  
    • Notice of Transfer and Charge – payable to the Landlord, Management Company or their agent, this is usually around £150 plus VAT.
    • License to Assign – often around £400 plus VAT.
    • Deed of Covenant – usually around £250 plus VAT.
    • Certificate of Compliance – approximately £200 plus VAT.
    • The above fees may naturally vary and this list is not exhaustive; other 3rd party costs may apply according to the particular Lease.

  • How much is Stamp Duty Land Tax?

    This amount will vary depending on your purchase price and circumstances, for example whether you are a first time buyer or own additional property.

  • When should I instruct Montpellier Legal?

    The earlier in the transaction the better. The advantage of speaking with our team before you have agreed a sale/purchase allows you to obtain a good understand of costs as well as verifying documentation and completing necessary paperwork. This can help speed up the overall process when the legal work begins.

  • Will I need to visit your offices?

    It is not essential that you visit our offices as our cutting edge technology enables us to complete your transaction remotely. However, unlike many firms who are online only, we are also able and very happy to meet any of our clients in person if preferred.
